SMS Policy & Terms of Service – Truckee Financial Group

This page explains how Truckee Financial Group (“Truckee Financial Group,” “we,” or “us”) handles personal information for its text messaging program and sets the rules for using that program. It covers two related documents: SMS Privacy Policy and SMS Terms of Service. Both apply to your use of our short message service and multi-media messaging service for marketing and non-marketing purposes through the Constant Contact, Inc. platform (the “SMS Services”). These terms address SMS only and sit alongside, but separate from, the general website Terms of Use and Privacy Policy.
SMS Privacy Policy
Agreement to SMS Terms
Your use of the SMS Services to receive text messages (“Messages”) from Truckee Financial Group for marketing and non-marketing purposes is governed by these SMS Terms of Service (“SMS Terms”) and by the SMS Privacy Policy described above. Enrolling in, using, or accessing the SMS Services means you agree to these SMS Terms and the SMS Privacy Policy. Participation in SMS Services is voluntary and does not form a condition of purchasing any product or service from Truckee Financial Group.
Description of SMS Services
Truckee Financial Group sends marketing, transactional, and non-marketing messages through the SMS Services. Marketing messages promote our products and services and include offers, promotions, informational or educational content, and reminders. Transactional and non-marketing messages relate to existing interactions or services and include confirmations, alerts, appointment notices, and service updates.
Messages are sent using automated technology and originate from multiple telephone numbers or short codes. Message frequency depends on your interactions with us. Truckee Financial Group does not charge for messages; standard message and data rates from your mobile carrier apply. SMS opt-in consents and associated mobile telephone numbers are not shared with unrelated third parties, except with service providers that support the SMS Services.
Eligibility for SMS Services
Enrollment in SMS Services is limited to residents of the United States who are at least 18 years of age. By opting in, you confirm that you live in the United States and meet the age requirement for participation.
User Opt-in and Consent
By providing your mobile telephone number to Truckee Financial Group through our website, forms, events, or other channels, you request and consent to receive recurring SMS messages at that number, including messages sent using automated technology. Consent is not required to purchase any product or service.
You confirm that you are the authorized user of the mobile number provided and agree to notify us of any change or reassignment of that number by contacting Support@truckeefinancialgroup.com . You accept responsibility for any issues, claims, or liabilities arising from failure to update your contact information.
User Opt-Out and Support
You can opt out of the SMS Services at any time by replying STOP, QUIT, CANCEL, OPT-OUT, or UNSUBSCRIBE to any message. A final confirmation message is sent once the request is processed, after which messages stop. To re-enroll, submit your mobile number again through our forms or reply START where available. The SMS Services recognize only the commands listed in these SMS Terms. Messages using other words or formats are not processed, and Truckee Financial Group and its service providers are not responsible for honoring requests that do not follow these instructions. Telephone numbers or short codes used for the SMS Services change from time to time and are communicated through messages or on our website. Messages sent to discontinued numbers or short codes do not reach us.
Disclaimer of Warranties and Limitation of Liability
SMS Services operate on an “as is” and “as available” basis. Truckee Financial Group and its service providers do not guarantee uninterrupted, timely, or error-free message delivery or availability across all locations or carrier networks. Message delivery and timing depend on your mobile carrier and network conditions outside our control.
Truckee Financial Group and its service providers are not responsible for delayed, failed, or misdirected messages or for any actions taken or not taken in reliance on a message. To the maximum extent permitted by law, Truckee Financial Group and its owners, officers, employees, contractors, and agents disclaim liability for indirect, incidental, special, consequential, or punitive damages, including lost profits or business opportunities, arising from or related to the SMS Services. Where liability exists despite this limitation, recovery is limited to the minimum amount permitted by law and remains subject to the liability limitations in the website Terms of Use.
Changes to SMS Services and SMS Terms
Truckee Financial Group reserves the right to revise, suspend, or discontinue the SMS Services, or to modify how they operate, at any time, with or without notice, subject to applicable law and carrier requirements. These SMS Terms are updated as needed to reflect changes in law, carrier rules, technology, or business practices. The “Last updated” date at the top of this page indicates when the SMS Terms were most recently revised. Continued use of the SMS Services after any change constitutes acceptance of the revised SMS Terms.
